Google Appeals After Being Found Guilty of Antitrust Practices in the US

On Monday, a Washington judge ruled that Google violated the law by pre-installing its search engine on various devices, thereby using its dominance to maintain a monopolistic position.

Google: A Monopoly on Trial

Often referred to as a tech behemoth, the American company Google has been found guilty of anti-competitive practices in the United States as of Monday, August 5. The core of these allegations centers around its search engine, the cornerstone of the company’s success.

Judge’s Ruling

A Washington judge ruled that Google misused its dominant position by creating a monopoly in the market. This assertion is largely based on contracts making Google the default search engine on various tech devices. In response, Google plans to appeal the decision.

According to documents reviewed by AFP, it was concluded that “after careful review of the testimonies and evidence, Google is a monopoly and acted to maintain this monopoly”.

Further solidifying its position, Google signed deals in 2023 to pre-install its search engine on numerous devices, resulting in payments up to $26 billion, a significant portion of which went to Apple.

Justice Department’s Reaction

The contracts were deemed barriers to market entry for competitors, and thus illegal by the U.S. Department of Justice.

Merrick Garland, U.S. Attorney General, hailed this as a “historic victory for the American people”, emphasizing that “no company is above the law” and affirming the department’s commitment to tackling anti-competitive practices.

Google’s Defense

Google argued that its search engine faces significant competition from platforms like Amazon, Facebook, and Expedia.

Ultimately, Google’s loss is seen by Emarketer as “massive”, noting that a ban on distribution agreements could be “damaging for Google”. This comes at a critical time for the company, already affected by financial market downturns.

The case continues, with a forthcoming hearing to determine the potential fine to be imposed on Google.
