OpenAI Wins Initial Copyright Lawsuit Against Raw Story and AlterNet

OpenAI is currently dealing with multiple lawsuits over unauthorized content use in training its AI models. Although one complaint was dismissed, Raw Story and AlterNet are considering refiling their claims.

OpenAI, a leading artificial intelligence organization, is currently at the center of multiple legal controversies. The company is accused of using content from various publications and books without explicit permission or adequate compensation to train its large-scale language models.
Judge Dismisses Lawsuit
A recent court decision saw Judge Colleen McMahon of New York dismissing a lawsuit against OpenAI filed by Raw Story and AlterNet. These media outlets claimed OpenAI used their articles to train its AI without consent. Unlike other lawsuits, their complaint was focused on DMCA provisions that protect “copyright management information.”
Copyright Information Removal
The plaintiffs argued that OpenAI removed author names, titles, and other metadata that identified their copyright from the articles used in training its language models. Judge McMahon stated that the plaintiffs failed to demonstrate they had suffered “an identifiable harm” from these actions. She also noted that the type of harm they cited was “not the kind of harm elevated” to warrant legal action, emphasizing that the likelihood of ChatGPT generating plagiarized content from their articles appears low.
Ongoing Fight for Raw Story and AlterNet
Despite the dismissal of their lawsuit, Raw Story and AlterNet are not ready to give up their fight. According to their lawyer, they are “confident [they] can address the concerns identified by the court with a modified complaint.”
